The Juvenile Justice Act came into force on the 15th of January 2015. It was a replacement of the Indian Juvenile Delinquency Law and states that juveniles in conflict with the law aged 16 to 18 shall be tried as adults should they be involved in any heinous offences. It also required all orphanages to sign up and demanded that a certain level of care had to be provided, including 40 sq. ft of personal space for each child. In order to guarantee the care of each orphan, a database would be organized in which the health and overall happiness of the children would be updated each month. Regular inspections would then be given to each orphanage to enforce any rules that were not otherwise being implemented.
While in theory, this new legislation would help improve the lives of millions of orphans, in practice there are a number of complications. In the City of Thiruvananthapuram, over 180 orphanages are believed to shut down as a result of being unable to meet these new requirements. In Idukki, a local district, over ¼ (20/78) of all orphanages refused to register with fear they would be closed down as a result of the new requirements. In total, over 1,000 orphanages are on the verge of collapse, unable to meet the new standards being imposed by the government. As a result, it is estimated that around 50,000 children in orphanages across the State face a very uncertain future.
Should an orphanage be shut down, the children who once lived there will become protected by the government. However, due to the overwhelming numbers of children who may be without a home, it is estimated the government will not be able to cope with demand. Multiple child welfare committees in states such as Idukki have asked the government for further support. As a result, many of the former orphanages will have to rename themselves as ‘hostels’ due to their inability to meet the standard requirements for a hostel. This is a clear insight into how dire the conditions are in many of these crowded orphanages.
With the help of donations, we can begin making a significant impact. Through our work and strong relations with local construction companies, we can help build orphanages that meet the new standards set out for the government. This will provide orphans with the chance to live in better conditions without cramped rooms and squalor. We can also limit the additional closing of orphanages throughout the country by providing them with the finances they need to maintain and upgrade their facilities. This provides orphans with certainty they will be able to live in conditions with their friends rather than being split apart and sent to various locations by the government.
